Dispute resolution
We aim to resolve all customer concerns directly and quickly. If you have an issue with an order, a product, or any aspect of your purchase, please contact us first at contact@models118.com. In our experience, most issues are resolved within one or two business days through direct communication, often faster than formal procedures.
If a matter cannot be resolved directly, the following options are available:
1. For consumers in the European Union: the European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr, where you can submit a complaint regarding goods purchased online.
2. For consumers in the United Kingdom (post-Brexit): the EU ODR platform no longer accepts complaints from UK consumers (the UK left the platform on 1 January 2021). UK consumers can seek free advice from Citizens Advice consumer service (https://www.citizensadvice.org.uk/consumer/) and may pursue claims through UK ombudsman schemes or county courts as appropriate.
3. For all consumers: we are willing to participate in dispute resolution procedures before a national consumer arbitration board in the consumer’s country of residence.
We commit to responding to any formal complaint within 30 days of receipt.
Applicable law and jurisdiction
Polish law governs our business. As J&L Models Katarzyna Tyła is registered and seated in Poland, the operations of Models118 are subject to Polish substantive law, including the Polish Civil Code (Kodeks cywilny) and the Polish Consumer Rights Act of 30 May 2014 (Ustawa o prawach konsumenta, Dz.U. 2014 poz. 827).
EU consumer protection applies alongside Polish law for EU consumers. Under Regulation (EC) No 593/2008 (commonly known as Rome I), Article 6, consumer contracts are governed by the law of the consumer’s country of habitual residence when the business directs commercial activities to that country. EU consumers retain the mandatory protective provisions of their own national consumer law in addition to the protections offered under Polish law.
UK consumer protection (post-Brexit). Rome I has been retained in UK law via the European Union (Withdrawal) Act 2018, and the United Kingdom continues to apply the same conflict-of-laws principles. UK consumers buying from Models118 therefore retain the mandatory protections of UK consumer law (notably the Consumer Rights Act 2015) alongside Polish law. Whichever provides stronger consumer protection in a given situation applies.
Jurisdiction for non-consumer disputes. For disputes that do not fall under EU or UK consumer protection rules (for example, business-to-business transactions), the competent court is the court located in Częstochowa, Poland, the seat of J&L Models Katarzyna Tyła.
